Welcome to ElevenApril! By downloading, installing, accessing, or using any of our mobile applications or services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms apply to all ElevenApril products, including but not limited to:

• BucketPal - Personal goal management application
• LiveMarquee - Dynamic scrolling text display application
• 3Things - Daily focus and productivity application
• Any future applications or services developed by ElevenApril

2. About ElevenApril

ElevenApril is an independent app development studio dedicated to creating thoughtful, privacy-focused mobile applications that help people live more intentionally and productively. We are committed to user privacy, data security, and delivering high-quality experiences.

3. Eligibility and Account Requirements

Age Requirements

• Users must be at least 13 years of age to use our Services
• Users between 13 and 18 years of age must have parental or legal guardian consent
• Users must have the legal capacity to enter into binding agreements

Account and Registration

• Most of our Services do not require user registration or account creation
• BucketPal allows optional profile setup (username, birthday, profile photo)
• LiveMarquee functions entirely on your local device without accounts
• You are responsible for maintaining the security of any account information

Regional Availability

Our Services are available worldwide through the Apple App Store, subject to:

• Apple App Store availability in your region
• Compliance with local laws and regulations
• Export control and sanctions restrictions

4. Description of Services

BucketPal

A personal goal management application offering:

• Unlimited goal creation and management (premium)
• Progress visualization and tracking
• Smart reminders and notifications
• Life progress tracking based on birthday and life expectancy
• Live Activity support (iOS 16.1+)
• Home screen widgets
• Statistical analysis and reports

LiveMarquee

A dynamic scrolling text display application providing:

• Scrolling text display with customizable settings
• Built-in camera and photo management features
• Customizable themes and appearance options
• Local photo storage and organization
• Text styling and animation controls

General Service Terms

• Services are provided for personal, non-commercial use unless otherwise specified
• All data is stored locally on your device (with optional iCloud sync managed by Apple)
• We continuously improve our Services through updates and new features
• Some features may require specific iOS versions or device capabilities

5. User Responsibilities and Acceptable Use

Permitted Uses

You may use our Services for:

• Personal productivity and goal management
• Creating and displaying text content for personal or commercial purposes
• Taking, organizing, and managing photos
• Customizing app appearance and settings
• Any lawful purpose that complies with these Terms and applicable laws

Prohibited Uses

You agree NOT to:

• Reverse engineer, decompile, or disassemble any part of our Services
• Attempt to extract source code or underlying algorithms
• Bypass, disable, or interfere with security features

• Create, display, or share content that is illegal, harmful, or violates others' rights

• Impersonate others or misrepresent your affiliation with any person or entity

Usage Restrictions:

• Use Services for any unauthorized commercial purpose without permission
• Resell, sublicense, or redistribute our Services
• Use Services to spam, phish, or engage in fraudulent activities
• Interfere with other users' ability to use the Services
• Violate any applicable local, national, or international law

Content Responsibility

• You are solely responsible for all content you create, store, or display using our Services
• You warrant that you have all necessary rights to use any content you input
• You agree to comply with all copyright, trademark, and intellectual property laws
• We do not monitor, pre-screen, or endorse user-generated content

Public Display

• When using LiveMarquee in public spaces, you are responsible for:

Our Intellectual Property

Ownership:

• All Services, including design, code, functionality, graphics, logos, and trademarks, are owned by ElevenApril
• "BucketPal," "LiveMarquee," "3Things," "ElevenApril," and associated logos are our trademarks
• Services are protected by copyright, trademark, patent, and other intellectual property laws

Your License:

• We grant you a limited, non-exclusive, non-transferable, revocable license to use our Services
• This license is for personal, non-commercial use only (unless otherwise specified)
• You may not copy, modify, distribute, sell, or lease any part of our Services
• This license terminates automatically if you violate these Terms

Your Content and Intellectual Property

Your Ownership:

• You retain all rights to content you create using our Services (photos, goals, text, etc.)
• We claim no ownership over your personal content
• Your content remains private and is not used for any purpose other than providing Services to you

No Rights Granted to Us:

• You do not grant us any license or rights to your personal content
• We do not access, view, or use your content for any purpose
• Your content stays on your device and is never uploaded to our servers

Third-Party Content

• You are responsible for ensuring you have rights to use any third-party content in our Services
• We are not responsible for any third-party content you choose to use
• Respect copyright and intellectual property rights of others

Digital Millennium Copyright Act (DMCA)

If you believe content in our Services infringes your copyright:

• Contact us at the email address provided in Section 16
• Include: description of copyrighted work, location of infringing content, your contact information, and a good faith statement
• We will investigate and take appropriate action

Apple as Third-Party Beneficiary

You acknowledge that:

• Apple is not a party to these Terms
• Apple has no obligation to furnish maintenance or support for our Services
• Apple is not responsible for product liability claims, intellectual property infringement claims, or failure to comply with legal requirements
• Apple and its subsidiaries are third-party beneficiaries of these Terms
• Upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary

7. Subscription Services and Payments

Free and Premium Plans

BucketPal:

• Free Plan: Limited number of goals, basic features
• Premium Plan: Unlimited goals, advanced features, Live Activity, priority support, all future updates

LiveMarquee:

• Free Version: Basic features with limitations
• Premium Features: Advanced customization, unlimited access, exclusive themes

Pricing and Billing

• Subscription prices, billing periods, and details are displayed in the app before purchase
• All purchases are processed through the Apple App Store
• Prices may vary by region and are subject to applicable taxes
• We reserve the right to change prices with advance notice
• Price changes do not affect existing subscriptions until renewal

Payment Processing

• All payments are handled by Apple through the App Store
• You agree to Apple's payment terms and conditions
• We do not process payments directly and do not have access to your payment information
• Billing and transaction processes are governed by Apple's terms

Subscription Terms

Auto-Renewal:

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel subscriptions in your Apple ID Account Settings

Free Trials:

• Free trials may be offered for premium subscriptions
• Free trials automatically convert to paid subscriptions unless cancelled before the trial ends
• Only one free trial per user, per application
• We reserve the right to determine free trial eligibility

Cancellation:

• You can cancel subscriptions at any time through your Apple ID settings
• Cancellation takes effect at the end of the current billing period
• No partial refunds for unused portions of subscription periods
• Access to premium features continues until the end of the paid period

Student and Special Programs

BucketPal Student Program:

• Students may apply for free premium membership
• Application requires verification of student status (student email or ID)
• We reserve the right to verify eligibility and grant or deny applications
• Free memberships may be subject to periodic re-verification
• Program terms may change with advance notice

Refunds

Refund Policy:

• All refund requests must be made through the Apple App Store
• We do not process refunds directly
• Refunds are subject to Apple's refund policy and terms
• Generally, refunds are not provided for change of mind or non-use
• Contact Apple Support to request a refund

Exceptions:

• Technical issues preventing use of Services may be eligible for refunds (contact us first)
• Unauthorized purchases should be reported immediately
• Accidental purchases may be refunded at Apple's discretion

8. Privacy and Data Protection

Our Privacy Policy is an integral part of these Terms. By using our Services, you also agree to our Privacy Policy, which explains:

9. Service Availability and Updates

Service Availability

Uptime:

• We strive to provide reliable, uninterrupted service
• We do not guarantee 100% uptime or availability
• Services may be temporarily unavailable due to:

Device Requirements:

• iOS 16.0 or higher (some features require later versions)
• Compatible iPhone or iPad device
• Sufficient storage space
• Active internet connection for downloads and updates (not required for app use)

Regional Availability:

• Services are available where the Apple App Store operates
• Some features may not be available in all regions due to technical or legal restrictions

Updates and Modifications

App Updates:

• We regularly release updates to improve functionality, security, and stability
• Some updates may be required for continued use of Services
• Updates may add, modify, or remove features
• We will notify users of significant changes through the App Store or in-app notifications

Service Modifications:

• We reserve the right to modify, suspend, or discontinue any feature or Service
• We will provide reasonable notice before making significant changes
• Continued use after changes constitutes acceptance of modifications

New Features:

• New features may be subject to additional terms or require premium subscription
• We may test new features with limited users before general release
• Features marked as "beta" or "experimental" may be unstable or change significantly

10. Disclaimers and Warranties

"AS IS" and "AS AVAILABLE" Basis

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that Services will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of content
• Warranties that defects will be corrected

Specific Disclaimers

No Medical or Professional Advice:

• BucketPal's life progress feature is for motivational purposes only
• We do not provide medical, psychological, or professional advice
• Do not rely on Services for critical decisions or health-related matters

Content Disclaimer:

• We do not endorse, monitor, or verify user-generated content
• You use content at your own risk
• We are not responsible for the accuracy or reliability of any content

Third-Party Services:

• Services may integrate with or link to third-party services (Apple App Store, iCloud, etc.)
• We are not responsible for third-party services or their availability
• Third-party services are subject to their own terms and policies

Data Loss:

• You are responsible for backing up your data
• We are not liable for data loss due to device failure, deletion, or other causes
• Always maintain backup copies of important data

Device Compatibility:

• We do not guarantee compatibility with all devices or iOS versions
• Performance may vary based on device specifications and conditions

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Exclusion of Damages

ElevenApril, its directors, employees, agents, and affiliates shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, use, goodwill, or other intangible losses
• Damages resulting from:

Liability Cap

• Our total liability shall not exceed the amount you paid us in the 12 months before the event giving rise to liability
• For free users, our total liability shall not exceed $100 USD
• Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you

• Nothing in these Terms excludes or limits liability for:

You acknowledge and agree that:

• These disclaimers and limitations are reasonable and essential elements of the agreement
• Without these limitations, we could not provide Services economically

12. Indemnification

Your Indemnification Obligations

You agree to indemnify, defend, and hold harmless ElevenApril, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:

• Your violation of these Terms or any applicable law or regulation
• Your violation of any rights of any third party
• Your use or misuse of Services
• Content you create, upload, display, or transmit using Services
• Your breach of any representations or warranties you have made
• Any disputes between you and other users or third parties

Defense and Settlement

• We reserve the right to assume the exclusive defense and control of any matter subject to indemnification
• You will cooperate with our defense of such claims
• You will not settle any claim without our prior written consent

13. Termination

Termination by You

Voluntary Termination:

• You may stop using Services at any time without notice
• Uninstall the app to remove all locally stored data from your device
• Cancel any active subscriptions through your Apple ID settings (cancellation takes effect at end of billing period)
• We do not store data on our servers, so uninstalling removes all your data

Effect of Your Termination:

• Your license to use Services terminates immediately
• Your data is deleted from your device
• Outstanding payment obligations remain due

Termination by Us

Grounds for Termination:

We may terminate or suspend your access immediately, without prior notice or liability, if:

• You breach these Terms
• You violate applicable laws or regulations
• You engage in fraudulent, abusive, or harmful behavior
• Your use threatens the security or availability of Services
• We are required to do so by law or legal process
• We decide to discontinue Services

Notice:

• We will provide reasonable notice when possible
• Immediate termination may occur for serious violations

Effect of Our Termination:

• Your license to use Services terminates immediately
• You must cease all use of Services
• Your access to premium features ends immediately (no refund for remaining subscription period)
• These Terms survive termination as specified in Section 14.5

Service Discontinuation

• We may discontinue Services at any time with 30 days' notice
• Active subscriptions may be refunded on a pro-rata basis at our discretion
• We are not liable for damages resulting from discontinuation

14. General Provisions

14.1 Governing Law and Jurisdiction

Applicable Law:

• These Terms are governed by the laws of the People's Republic of China
• International users: Also subject to your local consumer protection laws

• Any disputes shall first be addressed through good-faith negotiation
• If unresolved, disputes may be submitted to:

14.2 Dispute Resolution

Informal Resolution:

• Before filing a formal dispute, contact us to seek informal resolution
• We will attempt to resolve disputes through good-faith negotiation
• This informal process may take up to 60 days

Mediation:

• If informal resolution fails, parties may agree to mediation
• Mediation costs shall be split equally unless otherwise agreed

Arbitration (Optional):

• Parties may mutually agree to binding arbitration
• Arbitration shall be conducted in accordance with applicable arbitration rules

Class Action Waiver:

• Our failure to enforce any provision does not constitute a waiver of that provision or any other provision
• No waiver shall be effective unless in writing and signed by an authorized representative
• A waiver in one instance does not constitute a waiver in any other instance
• All rights and remedies remain available unless expressly waived in writing

14.7 Assignment

• You may not assign, transfer, or delegate these Terms or your rights without our prior written consent
• Any attempted assignment without consent is void

We are not liable for any failure or delay in performing obligations due to causes beyond our reasonable control, including:

• Apple App Store outages or changes in Apple policies

14.9 Survival

The following provisions survive termination of these Terms:

• Limitation of Liability (Section 11)
• Indemnification (Section 12)
• Governing Law and Dispute Resolution (Section 14.1-14.2)
• Any other provision that by its nature should survive

14.10 Language

• These Terms are written in English
• If translated, the English version prevails in case of conflict
• Translations are provided for convenience only

14.11 Export Control

• You agree to comply with all applicable export control laws and regulations
• Services may not be exported or re-exported to:
• You represent that you are not located in, under the control of, or a national of any such country or on any such list

14.12 Government Users

If you are a government entity or using Services on behalf of a government:

• Services are "commercial computer software" and "commercial computer software documentation"
• Government users have only those rights granted to other users under these Terms
• Use, duplication, or disclosure is subject to restrictions set forth in these Terms

15. Apple-Specific Terms

In addition to the other terms and conditions of these Terms, the following provisions apply to your use of our Services on iOS devices:

Acknowledgment

• These Terms are concluded between you and ElevenApril only, not with Apple
• ElevenApril, not Apple, is solely responsible for Services and their content

Scope of License

• The license granted to you is limited to a non-transferable license to use Services on Apple-branded products that you own or control
• You may not use Services on non-Apple-branded products

Maintenance and Support

• ElevenApril is solely responsible for providing maintenance and support services
• Apple has no obligation whatsoever to furnish any maintenance and support services

Warranty

• ElevenApril is solely responsible for any product warranties
• In the event of any failure to conform to any applicable warranty:

Product Claims

ElevenApril, not Apple, is responsible for:

• Addressing any claims relating to Services or your possession and/or use of Services
• Product liability claims
• Claims that Services fail to conform to any applicable legal or regulatory requirement
• Claims arising under consumer protection or similar legislation

Intellectual Property Rights

• In the event of any third-party claim that Services infringe that third party's intellectual property rights
• ElevenApril, not Apple, will be solely responsible for investigation, defense, settlement, and discharge of such claim

Legal Compliance

• You represent and warrant that:

• You must comply with applicable third-party terms when using Services
• This includes the Apple Media Services Terms and Conditions

Third-Party Beneficiary

• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms
• Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary
